1. Introduction

These General Conditions of Sale and Guarantees (hereinafter referred to as "General Conditions of Sale and Guarantees"), exclusively regulate the contractual relations between the customers of the quadrierighe.it site (hereinafter referred to as "Customers") and the seller DUE EMME srl with CF 02950270161 and VAT number IT02950270161, (hereinafter referred to as the "Seller"). These General Conditions are the only ones that can be applied and replace all other conditions, except for preliminary, express and written exceptions. The Seller may be obliged to modify some of these conditions; Customers are therefore advised to read the General Conditions of Sale and Warranties for each purchase on the quadrierighe.it site (hereinafter referred to as "the Site"). Each purchase on the Site is subject to the General Conditions of Sale and Warranties applicable on the date of the order. The Seller trusts that, once the order has been validated, the Customers have read and accepted without reservation the General Conditions of Sale and Warranties. Customers undertake to comply with the General Conditions and the Conditions of Use detailed in the 23 points in this section.

2. General introduction

Our site quadrierighe.it, sells clothing and accessories at retail. The sale takes place exclusively through our online site at www.quadrierighe.it owned by the Seller, a legal person who sells goods or services through the online sale, i.e. the contract stipulated exclusively within the context of the remote communication system commonly referred to as Internet.

3. Product Orders

Our products can be ordered from our website www.quadrierighe.it 24 hours a day and 7 days a week.

The order process at the checkout consists of the following steps. Once the choice of products has been made and the cart validated, the Customers will find themselves at the checkout:

- choose whether to create an account or proceed as a guest - alternatively, if you are already registered user, log in

- enter your data (of the buyer) and choose whether to send to another address other than the sender's address

- if at point 2 a different shipping address is chosen, enter the shipping address data

- choose the shipping method among the various options proposed

- choose the payment method among the various options proposed

- check the order, the correctness of the data entered and confirm the purchase 

To confirm the purchase, the customer must have accepted the General Conditions of Sale which will definitively formalize the sales contract that binds them to the Seller.

4. Information on Products

All information relating to the characteristics, descriptions, illustrative photographs of the products on our site are provided by our suppliers or made by our staff. If necessary, the Seller reserves the right to modify or adapt the information of the products in the catalog even without prior notice.

5. Sales prices

All sales prices of the products indicated on the Site in the catalog are expressed in euros as the final price but do not include shipping costs or the right of cash on delivery, which are always charged to the Customers. The Seller reserves the right to change prices at any time without notice, but equally undertakes to apply the prices indicated on the Site at the time the order is placed.

6. Minimum order

There is no minimum order amount, it is also possible to order a single product.

7. Product Availability

The availability of products is always indicated and updated to 95% in our online catalogs on our site. The state is divided into two categories:

If the purchased item is no longer available, the Seller will contact the customer by e-mail or by telephone within 24 hours of his purchase, informing him of the unavailability of the item, offering three possible solutions in the following order of priority:

- replacement with another item of equal value, in the case of a lower cost, the Seller will refund the difference, in the case of a higher cost, the Customer will have to integrate the payment of the missing difference

- if the customer has purchased more than one item, partial refund of the amount of the missing item

- if the customer has purchased only one item, full refund of the order

8. Accepted Payment Methods

The Seller uses the PayPal payment method to guarantee the security of Customer payments and the confidentiality of the credit card data used. Other payment methods are possible by bank transfer, cash on delivery (payment in cash upon arrival of the goods, directly to the courier | an extra cost of 4.50 Euro will be added for the right of cash on delivery, even in the case of free shipping). For the method of payment by bank transfer, the customer has 5 working days to make the payment. If the payment is not made within 5 working days, the Seller will cancel the order without notice. In the case of customization of the products, advance payment is required.

9. Shipping costs in Italy

Shipping costs are fixed throughout the Italian territory regardless of the weight of the package and the quantity of products purchased:

In the case of shipping to Calabria, Puglia, Sardinia and Sicily, the delivery time is estimated at least 24/48 hours longer than in the rest of the regions.

10. Shipping Costs Worldwide

Shipping costs in Europe are divided into three zones with a fixed amount regardless of the weight of the package and the quantity of products purchased:

ZONE 1: 12.90 EURO (shipping in 48/96 hours) - Free for orders over 99 EURO

ZONE 2: 13.90 EURO (shipping in 48/96 hours) - Free for orders over 99 EURO

ZONE 3: 14.90 EURO (shipping in 48/96 hours) - Free for orders over 99 EURO

ZONE 4: 19.90 EURO (shipping in 48/96 hours) - Free for orders over 149 EURO

ZONE 1: Austria, France, Belgium, Denmark, Germany and Luxembourg.

ZONE 2: Croatia, the Czech Republic, the Netherlands, Romania, Slovakia, Spain, Sweden and the United Kingdom.

ZONE 3: Bosnia and Herzegovina, Bulgaria, Estonia, Finland, Greece, Hungary, Latvia, Lithuania, Ireland, Poland, Portugal and Slovenia.

ZONE 4: Rest of the World

The Seller reserves the right to change the prices of shipping costs at any time without notice, but equally undertakes to apply the prices indicated on the Site at the time the order is placed.

11. Delivery methods in Italy

The shipments proposed by the Seller are made in Italy with DHL courier. The products purchased on our site are delivered only in Italy, with the exception of the towns of San Marino and Livigno. The Seller reserves the right to change the couriers used or the delivery methods at any time without notice, but equally undertakes to apply the couriers and delivery methods indicated on the Site at the time the order is placed.

13. Images, Texts, Graphics 

All the images and some texts of the products on our site are covered by copyright and owned by the manufacturers or suppliers or by the company DUE EMME srl. Their use is granted to the Seller as an authorized seller, or through the purchase of products from the wholesaler or factory that supplies exclusively original items with the acquitted contribution. Any abuse and / or non-compliant use will be prosecuted in accordance with the law.

14. Warranty

All the products on our site in the online catalogs benefit from any conventional guarantee that is directly provided by the manufacturers and the reference legislation as well as the methods of applying the guarantee will be those indicated and highlighted by the manufacturer together with the product. In addition to the conventional product warranty provided by the manufacturer, it is provided for in accordance with articles 128-135 of Legislative Decree no. 206/2005 also the legal guarantee for lack of conformity. The legal guarantee in favor of the consumer Customer (natural person who buys the goods for purposes unrelated to business or professional activity) covers the lack of conformity, existing at the time of delivery of the goods, which occurred within two years of delivery of the goods. . The lack of conformity must be communicated, under penalty of forfeiture, within two months from the date on which the consumer discovered the defect. The action against the seller is prescribed in any case within the term of twenty-six months from the delivery of the goods. In the event of a lack of conformity, the consumer customer has the right to restore, without charge, the conformity of the goods by repair or replacement, or to an adequate reduction in the price or termination of the contract, according to the provisions of art. 130 of Legislative Decree no. 206/2005, in this regard, the Customer must keep the invoice or order receipt that he will receive via e-mail in PDF electronic format. Once the product returned by the Customer has been checked, if following the checks and / or intervention on the product under analysis, it is noted that the reported defect does not integrate a lack of conformity pursuant to articles 128 and following of Legislative Decree no. 206/2005, the Customer will be charged for any verification and restoration costs incurred by the Seller, as well as transport costs, if incurred by the Seller.

16.1 Right of Withdrawal and Size Change - D.LGS N.206 / 2005

You have the right to withdraw from the contract, without giving any reason, within 14 days. The withdrawal period expires after 14 days from the day on which you or a third party other than the carrier and designated by you acquire physical possession of the goods. To exercise the right of withdrawal, you must inform us at the following addresses: (DUE EMME srl, VIA GB VEZZOLI 32 - PALAZZOLO SULL'OGLIO (BS) - 25036 | Tel: 030.7386068 ordini@quadrierighe.it) of your decision to withdraw from this contract by means of an explicit declaration (for example a letter sent by post, fax or e-mail). To this end, you can proceed with the return using the form available in the dedicated section of your account or use any other explicit declaration, we will send you a confirmation of receipt of the withdrawal by fax or e-mail. To meet the withdrawal deadline, it is sufficient for you to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

16.2 Effects of withdrawal

If you withdraw from this contract, you will be reimbursed for all payments you have made to us, including delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery to offered us), without undue delay and in any case no later than 14 days from the day on which we are informed of your decision to withdraw from this contract. These refunds will be made using the same payment method you used for the initial transaction, unless you have expressly agreed otherwise; in any case, he will not have to incur any costs as a consequence of this reimbursement. The reimbursement can be suspended until the goods are received or until the demonstration by the consumer that he has returned the goods, if earlier. Please return the goods to DUE EMME srl, VIA GB VEZZOLI 32 - PALAZZOLO SULL'OGLIO (BS) - 25036 without undue delay and in any case within 14 days from the day on which you communicated your withdrawal from this contract. The deadline is met if you send back the goods before the 14-day period has expired.The direct costs of returning the goods will be at your expense, you can follow two methods :

- request collection by one of our couriers at a cost of 8.90 euros;

- proceed with the shipment independently using your courier. You are liable only for any decrease in the value of the goods resulting from the handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods. 

16.3 Exclusion of withdrawal

The Decree regulates the cases, of which the consumer must be expressly informed, in which the right of withdrawal cannot be applied for tailor-made or "clearly personalized" packages.
The right of withdrawal cannot therefore be exercised: on customized products at the express request of the customer (eg customized products with embroidery or made to measure).

16.4 Conditions for the size change

If, upon receipt of the goods, the Customer notices the purchase of an incorrect size, the Seller allows the product to be exchanged within 14 days from the date of receipt, provided that the garment has not been used or damaged. The Seller will not accept exchanges or returns of used or damaged garments.

In the event of unavailability of the size concerned, it will be possible to change one model with another subject to prior agreement with the Seller.

Any return of purchased items must be carefully packaged and include the delivery note or the return form duly completed.

If you do not have a delivery note at the time of the exchange, download the return form by accessing the page containing the goods returns (in the My orders section of "My account" if the user has registered or in the Orders section if the user is not registered) available on quadrierighe.it.

Please return the goods to DUE EMME srl, VIA GB VEZZOLI 32 - PALAZZOLO SULL'OGLIO (BS) - 25036 without undue delay and in any case within 14 days from the day on which you have communicated your desire to change the size of the product. The deadline is met if you send back the goods before the 14-day period has expired. 

The direct costs of returning the goods will be at your expense, you can follow two methods:

- request collection by one of our couriers at a cost of 8.90 euros;

- proceed with the shipment independently using your courier.

The direct costs from sending the product with the correct size from the Seller to the Customer will be:

- to be paid by the customer in the case of a single product with a selling price of less than 179 euros (at a cost of 8.90 euros)

- payable by the Seller in the case of a single product with a sale price exceeding 179 euros. 

17. Liability

The Seller assumes no responsibility for inefficiencies attributable to force majeure which prevented, in whole or in part, from executing the contract within the agreed time frame. The Seller will not be liable for any damages, losses and / or costs incurred as a result of the non-execution of the contract for the reasons mentioned above, as the buyer is only entitled to a refund of the price paid.

In contracts that require the Seller to ship the goods, the risk of loss or damage to the goods remains with the Seller until the Customer physically takes possession of the goods. However, if the Customer offers alternative means of transporting the goods to those proposed by the Seller, then the risk of shipping remains with the Customer, without prejudice to the Customer's right towards the carrier.

Unless otherwise agreed by the parties to the sales contract, the Seller is obliged to deliver the goods to the consumer without undue delay and at the latest within thirty days from the date of conclusion of the contract. The delivery obligation is fulfilled by transferring the material availability or in any case the control of the goods to the Customer. If the Seller fails to comply within the deadline, the Customer invites the delivery to be made within an additional period appropriate to the circumstances. If the additional term thus granted expires without the goods having been delivered, the Customer is entitled to terminate the contract.

21. Customer Feedback, e-mails, comments, reviews, criticisms and communications

All opinions, Customer comments sent to the Seller are supervised, moderated and approved by the Seller. In the event that these opinions are contrary to laws or morality (abusive advertising, defamatory intentions, insults, improper comments) the seller reserves the right to reject or cancel the opinion in question.

22. Jurisdiction

For civil disputes relating to the application of this contract, the mandatory territorial jurisdiction is of the judge of the place of residence or domicile of the consumer, if located in the territory of the State.

23. Sales in Europe

Our website quadrierighe.it also sells in Europe with the exception of Cyprus, Croatia and Malta. In the case of requests and / or orders received from countries in exception, the seller will cancel the order and refund the amount paid for the value of the entire paid order. The quadrierighe.it site is in Italian and English, the customer who buys from European countries accepts the general conditions of sale.

24. Alternative dispute resolution
